Scope & General

The General Terms and Conditions for the Online Sale of Watches (hereinafter referred to as "GTC") apply to all legal transactions of Rösselet Schmuck & Uhren (hereinafter referred to as "Seller"), which are concluded by means of an order form. In the following, the term "clientele" is used for persons who purchase goods via roesselet.ch, whereby all genders are included.

The offer of roesselet.ch is directed exclusively at responsible persons with domicile in Switzerland.

Purchasing for commercial purposes is prohibited - in particular the commercial resale and distribution of goods ordered via roesselet.ch.

By agreeing to these terms and conditions, the customer is deemed to have accepted them. The version valid at the time of the order is decisive. Any general terms and conditions of purchase or other terms and conditions of the customer are expressly excluded. The customer can call up and view the GTC via links in the order form when placing the order.

Other terms and conditions, in particular those which the customer declares applicable together with the acceptance of the contract, shall only be valid if and to the extent that they have been expressly accepted by the seller in writing.

The seller reserves the right to change these terms and conditions at any time.

Order & Conclusion of Contract

An order is only possible if the customer has accepted these terms and conditions. For an order your e-mail address, your first and last name and your address are required. There is no claim to an order.

Orders via the website of Rösselet Schmuck & Uhren will be confirmed to the clientele by e-mail. A contract between the customer and Rösselet Schmuck & Uhren is only concluded with the confirmation (not automated). Rösselet Schmuck & Uhren is free not to accept orders.

It may happen that, despite confirmation, an ordered product cannot be delivered. In this case, Rösselet Schmuck & Uhren has the right to cancel the order and will subsequently inform the customer by e-mail. No subsequent delivery will be made. The payment already made will be refunded to the customer. If several products are ordered, but one product cannot be delivered, the customer is not entitled to cancel the purchase of the other products. Claims for non-delivery or late delivery are excluded.

Prices & Shipping

The prices published on roesselet.ch at the time of the order are valid. All prices are in Swiss Francs including the legal value added tax. 

For payment, the customer can only pay in advance. The goods will be shipped only after receipt of payment. 

Shipment is only possible within Switzerland. The shipment of the goods is registered and insured. The shipping is free of charge. The shipment of the goods is registered and insured. The shipment is free of charge.  

The customer is obliged to check the goods for defects upon receipt. Otherwise, the goods shall be deemed to have been received by the customer in perfect condition.

The risk is transferred to the customer as soon as the shipment has been handed over to the person carrying out the transport. If the shipment is delayed or becomes impossible through no fault of Rösselet Schmuck & Uhren, the risk is transferred to the purchaser with the notification of readiness for shipment. An assumption of the transport costs by Rösselet Schmuck & Uhren agreed in individual cases has no influence on the transfer of risk.

Presentation of the goods, delivery time, availability

Images of goods on the website of Rösselet Schmuck & Uhren are for illustration purposes only and are not binding. The same applies to details of the individual goods, as these are for information purposes. Only the information provided by the manufacturer (e.g. regarding manufacturer's warranty) is authoritative.

We reserve the right to change the goods indicated on the website of Rösselet Schmuck & Uhren at any time and without prior notice and to limit the number of items available for purchase by customers.

All information on the website of Rösselet Schmuck & Uhren regarding the availability and delivery time of goods is without guarantee.

Delivery is subject to the condition of timely and proper self-delivery by suppliers. In the event of force majeure such as strikes and other labor disputes, riots, war, natural disasters, as well as in the event of a suspension of delivery by the manufacturer or sub-supplier, there shall be no delay in delivery. The seller is not liable for delays in delivery caused by manufacturing companies or third parties.

Complaints

If a defect is discovered, the customer must contact Rösselet Schmuck & Uhren immediately.

Rösselet Schmuck & Uhren offers the same warranties to the clientele that they receive from the manufacturers or suppliers.

Subject to the warranty provisions of the manufacturer or supplier, the warranty is in any case limited - at the discretion of Rösselet Schmuck & Uhren - to repair of the defective products or delivery of a replacement for the defective product. All subject to timely notification of defects. 

Any further warranty claims of the customer, in particular rescission, reduction and compensation, are hereby expressly excluded, insofar as legally permissible. 

Return & right of withdrawal

A return must be made within 14 days of receipt of the goods. For the return or exchange, Rösselet Schmuck & Uhren must be contacted. There is no general right of the clientele to return the ordered products.

The goods must be returned new and unused. The products must be returned in their original packaging and undamaged. Labels and protective foils must not be removed.

Engraved, altered, worn or damaged goods as well as custom-made products are excluded from return. 

Returns are at the expense and risk of the customer and must be returned as a registered package. 

If the return is not made according to these instructions, the seller is entitled to offset the corresponding material value of the non-returned items against the refund to be paid out to the clientele. Offsetting shall also take place if the goods are damaged during return transport due to the fault of the clientele.

Retention of title

Until full payment of the respective invoice amount of a delivery (final and unconditional crediting of the total purchase price), the Seller shall retain title to the delivered goods in any case.

In the case of customers domiciled in Switzerland, the Seller shall be entitled to make a corresponding entry in the retention of title register.

Liability

The liability of the seller for slight negligence is excluded. The liability for auxiliary persons is completely excluded. 

In particular, the Seller shall not be liable for damage caused by any of the following: (1) improper storage, adjustment or use of the goods contrary to the terms of the contract, (2) use of incompatible spare parts or accessories, (3) failure to maintain and/or improper modification or repair of the goods by the customer or a third party, (4) force majeure, in particular damage caused by the elements, moisture, falls, blows, etc., for which the seller is not responsible, and official orders.

Data protection

The collection and processing of personal data about customers by the seller is explained in the privacy policy. This forms an integral part of the contract of these GTC. The privacy policy is available under imprintimprint.

Final provisions & place of jurisdiction

If any part of this Privacy Policy is found to be unenforceable or invalid for any reason, the validity of the remaining provisions shall not be affected. Swiss law is exclusively applicable. The place of jurisdiction for natural persons is Zug or at the customer's place of residence. For legal entities, the exclusive place of jurisdiction is Zug.
